To keep the first federal trial involving Vioxx moving as scheduled, U.S. District Court Judge Eldon Fallon decided late last week to relocate the hearing to Houston, after discussing the move with attorneys on both sides.
Fallon and a number of staffers moved to a temporary location at a federal courthouse in Houston shortly after Katrina destroyed much of the middle Gulf Coast from New Orleans east to Mobile, Ala. The move was necessary to maintain control over and streamline more than 1,800 federal lawsuits related to this toxic drug.
The first federal trial involves the death of Richard Irvin Jr. who suffered a fatal heart attack after taking Vioxx for only a month to relieve back pain.
