Medical Malpractice is a Disaster

A report on the medical liability lawsuit industry in America by Trial Lawyers Inc. reports that "soaring jury verdicts are producing outstanding returns for the lawsuit industry even as they drive up insurance costs and make it difficult for patients in some areas to find doctors or hospital care." According to the report, the median jury award for medical liability cases rose 43 percent to $1 million in 2000, and by the next year 52 percent of all awards exceeded that amount. Tort system costs, under which medical liability lawsuits fall, reached $205.4 billion in 2001, more than two percent of the nation's gross domestic product. In a typical tort case, attorney fees (plaintiff and defense) account for 33 percent of costs; administrative costs take up another 21 percent, and the patient is left with the remaining 46 percent.
