Both the U.S. Air Carrier Access Act and an order signed by President Biden stipulate that persons with a disability who cannot wear a mask are exempt from mask-wearing on public transportation, including airplanes, but Spirit Airlines insists their rules supersede laws and government — and subsequently kicked a 4-year-old child with autism off one of their planes for not wearing a mask.
The child’s parents said he is nonverbal and they had a medical note with them stating he’s exempt from wearing a mask. The family flew on Spirit to Las Vegas with no problems, but Spirit wouldn’t let them stay on a return flight.
Spirit said they had instituted a no-exceptions policy in May 2020 that the only exemptions they honor are for children younger than 2 years old.
