In a win for independent businesses, the U.S. Supreme Court ruled 6-to-3 that the Biden administration cannot enforce its edict requiring businesses to mandate the COVID-19 shots for all employees or undergo weekly testing and mask-wearing.
On the down side, the court ruled that mandates for health care workers in facilities that receive federal Medicare and Medicaid can be enforced. In this ruling, Justices Clarence Thomas and Samuel Alito dissented, saying, “The challenges posed by a global pandemic do not allow a federal agency to exercise power that Congress has not conferred upon it. At the same time, such unprecedented circumstances provide no grounds for limiting the exercise of authorities the agency has long been recognized to have.”
The ruling for health care workers covers most of those employed in the U.S., according to STAT News.
